Anti-smoking Law Applies to Native Reserves

May 22, 2002 HALIFAX (CP) - The Nova Scotia government does not know whether its new anti-smoking law will apply to native reserves. Many restaurant and bar owners are worried native reserves will be exempt from the law and customers who smoke will go to reserves to eat and drink.

Justice Minister Michael Baker says the government has not yet looked into whether natives are exempt from the law under powers set out by the federal government. That's currently the case with the Sunday shopping law - stores on native reserves can open on Sundays.

Baker says it's not really an issue until the smoking law comes into effect next January. Liberal Michel Samson says that's not right. He says businesses want to be on a level playing field.

Samson says many bar and restaurant owners have told the government they could be forced to cut jobs or even go out of business if there are different rules for different establishments.
